General terms and conditions (GTC)
1. Fields of application
For the fields of application between Mathis Food Affairs (hereinafter referred as MFA) and the client (hereinafter referred as ‘you’, ‘your’) the following general terms and conditions and / or the Swiss Code of Obligations are applied.
2. Purchase agreement conclusion
In introducing products in the online shop, MFA makes a binding offer for the conclusion of an agreement for these articles. The agreement is reached as soon as the client has sent a binding order for the articles contained in the basket by clicking on the button ‘Send order’. The confirmation of reception of the order follows by email immediately after sending the order and is at the same time the acknowledgement of the order for the client.
3. Right of cancellation
The client can cancel the declaration of agreement within (two weeks) in writing (i.e. letter, fax, email) or by returning the article, without giving any reason. In order to meet the deadline, sending the cancellation (or the article) in time is sufficient. The cancellation must be sent to: Mathis Food Affairs, Corviglia, CH-7500 St. Moritz, email: , Fax: +41 (0) 81 833 85 81.
Cancellation consequences:
In the case of an effective cancellation the goods and services received on both sides must be returned (and possible applications must be returned). If the client cannot or can only partly return the accomplishments received, or they are in a deteriorated condition, the client is obliged to provide appropriate compensation. (In the case of relinquishment of articles this is not relevant if the deterioration of the article is solely attributed to its examination – just as could have happened to the client in a shop). The client can avoid the obligation of compensation by not making use of the article at all. It must be safeguarded from anything that could reduce the value. Articles that can be sent in a parcel must be returned to MFA. The client must bear the costs for the return if the delivered goods correspond to the ordered ones and if the price of the returned articles does not exceed the sum of CHF 60, or in the case of a higher price, if the client has not provided the goods and services in return or a stipulated part payment at the moment of cancellation. Otherwise the return fee is waived for the client. The client must carry out his obligations of refunding within 30 days after having sent the declaration of cancellation.
4. Guarantee (warranty)
The warranty is provided according to the legal requirements. Moreover, MFA grants a guarantee of at least 12 months as from the date of purchase (except for consumer goods with a declared expiry date). In borderline cases, MFA will apply the so called ‘goodwill guarantee’ according to internal guidelines, in favour of the client.
5. Privacy policy
MFA does not share personal data of clients with third parties, including addresses and email addresses. Exceptions to this are the service partners of MFA who require such personal data for the processing of the order. In this case, the extent of the transmitted data is limited to the minimum essential.
At the MFA online shop, cookie information is stored about the contents of your basket, and this can be called up during the client’s next visit. When the client registers with us or would like to pass an order, MFA needs the client’s data. If the client already has an account with MFA, he can simply register by means of his email address and his personal password. The created cookies have an expiry delay of 365 days. Furthermore, you can manage the acceptance of this page’s cookies in your browser programme and block them if you wish.
MFA uses the client’s inventory data exclusively for the processing of the order. The necessary data for business purposes (indication of address, order information etc.) are safely used and saved on the MFA system according to the Swiss data protection law. After registering for the MFA newsletter the client’s email address is stored for publicity and market research reasons until cancellation.
The client has the right at all times to request, free of charge, information, correction, blocking and, if necessary deletion of the saved data.
6. Reservation of ownership
The delivered goods remain the property of MFA until payment is completed.
7. Final clauses
- MFA reserves the right to make price changes at any time, and cannot be held accountable for errors.
- MFA is not responsible for the contents of partner pages, and accordingly is not liable for these either. The partners’ own regulations govern such pages.
- Insofar as permitted by law, MFA assumes no liability following improper treatment or concerning products sold by MFA.
- Legal requirements are applied according to the Swiss Code of Obligations.
